IBC Legal Services won a 5-year trial and retained the Liberman Estate in the ownership of National Writers’ Union of Ukraine

Today, the Kyiv Economic Court of Appeals decided to demolish illegal buildings on the territory belonging to the Lieberman Mansion, located on the vulytsia Bankova, 2, opposite the Administration of the President of Ukraine. The mansion was built in the 1870s, it is a monument of architecture, as well as the history of the city, and has been a property of the National Writers’ Union of Ukraine for over 20 years. The decision of the Court of Appeal came into force.

 

The case has been going on for about 5 years, a large number of participants has been involved in the process, including private individuals and prosecutors.

The case is commented by the IBC Legal Services lawyer Oleksii Palii, who has been in charge of this process for several years now:

"An attack on the monument of architecture on the basis of the illegal construction on its territory began in 2010. In a matter of time, the case was transferred to the court, where it was repeatedly revised by the courts of all instances and multiplied by the number of related trials. Today we have received a well-founded and fair decision of the Court of Appeal, which ordered the demolition of illegal buildings on the territory of the 150-year-old Mansion. Despite the fact that this is far from the end for the dispute as a whole, it is an absolute victory that says that fair decisions still occur even in the most resonant processes, when the social and financial inequality of the parties is obvious (for example, the National Writers’ Union of Ukraine is a non-profit organization, and their opponent is a well-developed commercial structure.) We hope that the cassation instance will maintain the position of justice and impartiality of the court and apply the maximum of our professional efforts to this".
